PRIVACY POLICY (PC)

The European General Data Protection Regulation (GDPR) came into force in France on 25 May 2018. Its purpose is to harmonise European legislation on the protection of personal data by giving individuals more rights and ensuring they are better protected in terms of how their personal data is used by organisations.

In order to carry out its activities of coordinating the community of TBS Education graduates and students by updating an alumni directory and organising events in France and abroad, as well as in the context of its relations or events organised by TBS Education, its incubator or the TBS Education Foundation, TBS Alumni uses data collected on its Website (or ‘Site’). TBS Alumni ensures strict compliance with the confidentiality of this collected data.

1.Responsibility for processing

TBS Alumni undertakes, as data controller, to comply with the provisions of Law No. 78-17 of 6 January 1978, as amended, and the GDPR published in the Official Journal on 27 April 2016 and in force since 25 May 2018.

In order to ensure compliance with these rules, TBS Alumni has appointed a designated representative to liaise with the French Data Protection Authority (CNIL) and act as a point of contact within the organisation for matters relating to personal data protection. This representative can be contacted by post or email.

Personal data (hereinafter referred to as ‘Data’) is defined as any information relating to an identified or identifiable natural person. A person is considered to be ‘identifiable’ if they can be identified, directly or indirectly, namelly by reference to an identifier such as a name, an identification number, location data, an online identifier, or factors specific to their physical, physiological, genetic, mental, economic, cultural or social identity.

 

2.Data collected

TBS Alumni only collects and processes data that is strictly necessary for the purpose(s) for which it is processed.

TBSA also takes all necessary measures to ensure that alumni data is accurate, complete and, where applicable, updated.

The data collected includes, in particular:

  • Title, surname and first name of the alumnus or alumna
  • Date of birth and nationality
  • Academic and professional background
  • Email and telephone contact details
  • Website user accounts: login and password

 

This list of data types is not exhaustive and may be subject to change without notice.

For information on payment data, see the section entitled ‘Hyperlinks and bank details’.

In addition, when you use the Site, we automatically collect information, including personal information, about the Services you use and how you use them, including:

  • Usage information: we collect information about your interactions on the Website, such as your page or content views, searches, any purchases you have made, and other actions on the Website for the purpose of improving the Site's Services.
  • Connection and device data: we automatically collect connection and device data when you access the Website. This information includes, among other things:
    • information about how you used the Website, IP address, dates and times of access, data about computer hardware and software, data about the device, data associated with the use of the device, unique identifiers, and cookies.
    • This information allows us, in particular, to improve the performance of the Website and the quality of the Services offered via the Site, but also to detect and prevent fraud, spam, abuse, security incidents and other harmful activities.

 

3.Image rights

When registering for one of our events, the User agrees to appear in photos and/or videos that may be taken during the event. TBS Alumni guarantees that its content will only be used to promote its events within the TBS Alumni network. Users have the right to refuse the use of their image, but they must explicitly communicate this to the TBS Alumni team in writing (by email or letter) preferably before the start of the event.

 

4.Management of user content

Users are informed that their testimonials and comments may be reproduced and/or represented in communication materials intended to promote TBS Alumni. In the event that these comments and testimonials are likely to be protected by intellectual property rights, Users expressly consent to TBS Alumni being able to use these comments and testimonials freely and free of charge for the legal duration of the protection of these rights.

 

5.Legal basis for processing.

TBS Alumni only collects and processes personal data about you for which it has a legal basis. The legal bases include your consent (when you have given your consent to the processing of data), the contract (when the processing of data is necessary for the performance of the contract between TBS Alumni and you or TBS Education and you), compliance with legal obligations, and the ‘legitimate interests’ of TBS Alumni, which consist in particular of informing you about its news or events, ensuring the security of the Website, or improving its functionality.

 

6.Purposes of data collection

TBS Alumni uses your data solely in the context of its activities to promote the TBS Education alumni community (graduates and students), and for specific and limited purposes of development and monitoring: 

   - alumni relations

  -  external information and communication (newsletters, membership fees, etc.)

   - organisation of workshops or events; as an exception, TBS Alumni may provide the speakers at an event it organises and the institution hosting the event with a list of participants, limited to their surname, first name and declared employer.

 

TBS Alumni also uses your data to compile the TBS Education alumni and student directory, in its electronic version, and to manage user accounts on the reserved online platform.

 

7.Recipients of data

TBS Alumni only shares the data it collects with its internal departments, staff, volunteers (clubs, tribes, etc.) and its partners (TBS Education and the TBS Education Foundation), as well as its service providers and their staff in relation to the performance of the services entrusted to them and which they must perform on behalf of TBS Alumni or for the benefit of TBS Education.

 All persons with access to your data are authorised, determined and bound by a confidentiality obligation.

 

8.Data retention

Your personal data will be retained by TBS Alumni for a period not exceeding the time necessary for the purposes for which it was collected or processed, in accordance with the provisions in force. As such, TBS Alumni retains your personal data for as long as your ‘Alumni’ profile is active. After a period of 11 years of inactivity, the account will be deemed ‘inactive’ and your data will be deleted.

 

9.Transfer of data outside the European Union

TBS Alumni outsources some of its processing and may, in this context, transfer data outside the European Union. In this case, TBS Alumni undertakes to enter into a confidentiality and data security agreement with the recipients of the transferred data, guaranteeing an adequate level of protection.

 

10.Data security

TBS Alumni takes care to protect and secure your personal data.

In this context, TBS Alumni implements appropriate technical and organisational measures to prevent, as far as possible, any alteration or loss of your data, as well as any unauthorised access to it. 

However, no method of transmission over the Internet or method of electronic storage is 100% secure. Therefore, although TBS Alumni does its utmost to protect your personal data, it cannot control the risks associated with the functioning of the Internet and draws your attention to the possible risks in terms of occasional data loss or breaches of confidentiality of data transiting via this network.

11.Your rights

In accordance with Law No. 78/17 of 6 January 1978, known as the ‘Data Protection Act’, as amended, and the General Data Protection Regulation (EU) 2016/679 of 27 April 2016, known as the ‘GDPR’, you have:

  • a right of access (Article 15 of the GDPR): the right to obtain confirmation as to whether or not data concerning you are being processed, and if so, access to those data;
  • a right of rectification (Article 16 of the GDPR): the right to obtain, as soon as possible, the rectification of inaccurate data concerning you and the completion of incomplete data;
  • a right to the removal of data (Article 17 of the GDPR): the right to obtain, as soon as possible, the removal of data concerning you if you have withdrawn your consent to the processing, if you object to the processing, if the data are no longer necessary for the purposes of the processing, if they have been unlawfully processed, or if they must be erased in accordance with a legal obligation. However, it is not possible to permanently delete your profile from our database, as it contains details of your academic career and proof of your graduation. We can make this profile completely invisible to anyone visiting the site and delete any information not related to your graduation.
  • the right to restrict processing (Article 18 of the GDPR): the right to obtain restriction of processing, in particular if you contest the accuracy of the data, when their processing is unlawful, or if you need it for the establishment, exercise or defence of your legal rights;
  • the right to object (Article 21 of the GDPR): the right to object at any time to the processing of data based on Article 6(1) point e) or f) of the GDPR, for reasons relating to your particular situation, except where there are legitimate and compelling grounds for the processing which override your interests and rights and freedoms or for the establishment, exercise or defence of legal claims, and the right to oppose to processing for direct marketing purposes;
  • the right to data portability (Article 20 of the GDPR): the right to receive data in a structured, commonly used, machine-readable format and to transmit it to another data controller without hindrance from the initial data controller, where the processing is based on consent or on a contract and carried out using automated means;
  • the right to give instructions on what should happen to your data in the event of your death.

You can modify your personal privacy settings regarding the display and/or transmission of your data on our Website at any time via your online account (under ‘My Profile/Profile Privacy Settings’).

You also have the right to lodge a complaint with the French Data Protection Authority (CNIL) at this address.

 

12.Hyperlinks and bank details

TBS Alumni provides links to other websites, mainly partner sites (Nominations, etc.), or links to other pages (TBS Education, the TBS Education Foundation, etc.).

TBS Alumni also provides links on its website for you to book and pay online for your registration for an event or your membership fee. When you make a payment, specific information is collected, including the date, the amount of the purchase, and other details related to the transaction.

These web pages are not part of the TBS Alumni portals. The Association is therefore not responsible for their content. We recommend that you consult the personal data protection policies of these service providers, as their terms and conditions may differ from those of TBS Alumni.

 

When you pay for a service on the website (event registration, membership fees, etc.), we do not store any credit card or bank account details for deferred payment of membership fees. This information is processed by our online payment processor, Stripe, and/or our bank.

For one-off membership fee payments or event payments, this information is stored for 13 months after the debit date, in accordance with CNIL guidelines. Under no circumstances will your credit card information be disclosed to third parties, except in the event of a dispute.

 

13.Unsubscribe

As a member of the TBS Alumni network, you will receive a certain amount of information and communications. In addition to managing your privacy settings, you can also choose to no longer receive these communications by going to the ‘My Profile / Email Settings and Subscriptions’ section after logging into your account.

This section allows you to select in detail the types of communications you wish to receive or not, by checking or unchecking the boxes provided for this purpose. If you no longer wish to receive newsletters and solicitations from TBS Alumni, you can click on the unsubscribe link at the bottom of our communications or contact us by email.

General Terms of Use (GTU)

 

Purpose

The website, available at www.tbs-alumni.com, is a private professional social network provided by ‘TBS Alumni’ - the non-profit association of students and graduates of TBS Education (formerly ESC Toulouse) to enable its members to help each other, keep in touch, enable networking, share opportunities, exchange advice, sponsor education, and encourage professional integration, employment and career development. The Website and its Services are provided by the service provider ‘Netanswer’ of the EudoNet group.

 

The purpose of these GTU is to govern access to and use of the Website. We invite you to read them carefully.

 

Any other use of the Website for purposes other than those mentioned above and in these General Terms of Use, namely for commercial purposes, is strictly prohibited.

 

Definitions

Terms beginning with a capital letter in the GTU have the following meanings (unless expressly stated otherwise):

- Website refers to the TBS Alumni website accessible at www.tbs-alumni.com, which provides access to the network's Services.

 - Users refers to members who can access the Services via an Account (students, graduates, partners, recruiters) and/or individuals who register for an event. For each type of User, access to the Services may be limited depending on the choices made by the Administrators.

 - Visitors refers to individuals who visit the Website without registering or logging into an account.

 - Administrators refer to individuals employed by or volunteering for TBS Alumni or employees of TBS Education authorised by TBS Alumni to use the Netanswer application modules for professional or management purposes: they have access to an Account allowing them to set up the Modules and configure or perform actions on User Accounts.

 - Account refers to a valid account providing access to the Website Services. A valid account refers to an account that has not been blocked or restricted by an administrator.

 - Content refers to any content that Users can access from the Website, including but not limited to articles, events, TBSocial network (online directory), profile information with Personal Data depending on the privacy settings that each User has configured in their preferences.

 - Personal Data refers to any information relating to a User that allows a natural person to be identified directly or indirectly.

 - Modules refers to community management applications/private online directories developed by Netanswer and accessible as ‘software as a service’ (SaaS).

- Legal Notice & Privacy Policy (LNPP) refers to the document drawn up by TBS Alumni setting out its processing of Users' Personal Data and defining their corresponding rights.

- Services refers to the provision of Modules and additional services that may be provided at the request of TBS Alumni by Netanswer, including configuration, support or training, etc.

 

Scope of the Terms and Conditions of Use

These GTU apply to all use of and access to the Services of the Website. They are electronically validated by the User when activating their Account (first login). The Terms and Conditions of Use are accessible at any time on the Website.

 

By accessing your Account, requesting a password, making a reservation for an event or making a purchase on the Website, or any other action on this Website, you acknowledge that you have read and accept these Terms and Conditions in their entirety.

 

TBSocial Network (online directory) is not freely accessible. Access is reserved for Users of the network who have accepted the GTU and have an Account with a username and password.

 

Description of Services provided by TBS Alumni

For information purposes, TBS Alumni offers its members the following Services: 

  • A participatory network information and sharing service (news, events, newsletters, comments, notifications, sharing on social networks, etc.).
  • A private online directory – TBSocial Network – of User members with access to User profiles including private data.
  • A service for connecting User members via an internal messaging system.
  • A job offer service.
  • An online membership service for those who are not yet members of the Association.
  • A ticketing service for the various events on offer.

 

All these Services are designed to bring TBS Alumni members closer together with the aim of promoting networking, mutual support, professional integration and career development.

 

Access to Services

The User of the Website acknowledges that they have the necessary skills and means to access the Website and have verified that the computer configuration used does not contain any viruses and is in perfect working order.

In order to access the network, Users must be graduates, students or partners of TBS Alumni and have an active email address to activate their Account and participate in the network. Their Account must have been created in advance by an Administrator of TBS Alumni or TBS Education.

Anonymous visitors can access the Website, view articles and public events, but cannot access TBSocial Network (online directory), visit profiles, post comments or send messages. They can access registrations for events open to the public. In this case, they must accept the Terms and Conditions of Use to reserve their participation in this type of event and provide at least their first name, last name and an active email address.

Users who are recruiters or representatives of a partner company may join the network with restricted access in order to post job offers. These accounts must be validated or created in advance by a TBS Alumni Administrator.

 

The User undertakes not to use a pseudonym or email address that could infringe on the rights of third parties (surname, trademark, etc.), nor to usurp a name, company name or registered trademark.

When logging in for the first time, the User must accept and validate the GTU and LNPP. The User may also update their Account preferences at any time with regard to notifications and the confidentiality levels of their profile information.

After prior notification of the User by email, their Account may be deactivated by an Administrator if it remains inactive for more than 11 years.

 

Administrators

The Administrator configures User Accounts via imports or individual additions (manual, at the user's discretion, or from a TBS Education synchronisation). They configure and validate User access requests, such as those from partner company representatives. The Administrator can send access details to each User. The Administrator is able to block access to a User.

User Accounts

The User will be able to access the Services once the GTU and LNPP have been validated and only if the User's Account has been created in advance by an Administrator with at least a First Name, a Number and an active Email Address.

The User will need to provide at least one active email address and specify a password to identify themselves when logging in for the first time. They can modify and update their email address and password at any time from their Account management screen.

They will then access their User menu to access the various Modules of the platform in accordance with the access rights authorised for their User type.

 

Password

The password associated with each Account is strictly personal, confidential and must not be shared with third parties. Users are responsible for the loss or theft of their password. We recommend that Users change their passwords regularly and choose complex passwords of at least 8 characters, including letters, numbers and special characters.

 

Each User is free to change their password at any time from their Account management page and is solely responsible for all actions on their account, even in the event of password loss.

 

Use of services

The texts, software, images, videos, data and any other work on this Website are protected by intellectual property law. Users of the Website agree not to reproduce them without the express consent of TBS Alumni. Users agree not to copy or sell all or part of the Modules and the Website.

 

Users guarantee to TBS Alumni that they have the necessary rights, including all intellectual property rights, to the articles, testimonials, comments, images and data of any kind that they disclose on this Website, enabling them to grant the rights transferred herein.

 

When writing a comment and/or testimonial that may be protected by intellectual property rights, the User expressly agrees that TBS Alumni may use them freely and free of charge for the legal duration of protection of these rights.

When registering for a TBS Alumni event, the User acknowledges that they agree to receive communications from the association. If the User changes their mind, they may request to unsubscribe from TBS Alumni by post or email.

Messages and images posted on the website and/or its account are the responsibility of their author, who undertakes to assume all responsibilities and consequences relating thereto. In particular, the author of a message indemnifies TBS Alumni against any actions brought by third parties and having as their cause, basis or origin the content of their message. The representatives of the Website decline all responsibility for the content of messages and images posted by users.

The User is responsible for the Account assigned to them from the date of their first login. It is their duty to keep their login details and password secret and not to disclose them to any other person. The User is solely responsible for the use made of their Account, as well as for the Content published via their Account.

For the respect and well-being of all, the following are prohibited: messages that are abusive, offensive, obscene or defamatory; content that infringes on the rights of others; violent language or language that incites racism, pornography, paedophilia or crimes and offences; and the misuse of the Site for propaganda, commercial prospecting or political purposes.

Users may report any disturbing messages or images to the Administrator. The Administrator may delete any message that does not comply with the above conditions without prior notice.

TBS Alumni reserves the right, without justification, to refuse access to the Site to any Visitor or User who has not complied with these terms of use or applicable law. In the event that, in the opinion of the Visitor or User concerned, this is an error, the latter may contact TBS Alumni.

 

TBSocial Network online directory

TBS Alumni provides its members (graduates and students) with an online directory of TBS Education’s students and graduates.

The online directory is available to Users for consultation only, to promote exchanges between its members and/or partners, exclusively for non-commercial purposes.

Misuse of the directory for other purposes, such as:

  • Those mentioned above
  • Fraud
  • Identity theft
  • Making it available to third parties
  • Direct or indirect use for commercial prospecting purposes
  • Constitutes a violation of these Terms and Conditions of Use. This list is not exhaustive and may change over time.

 

Any extraction or reproduction of data from the directory, in any form, without the consent of TBS Alumni is strictly prohibited.

Participation in Groups

The Site allows Users, if the Groups Module is active, to create restricted circles within the network. They can organise themselves into groups, for example around a city or region or a professional theme. Members of each group can thus access articles, events, forums, media, and an electronic directory specific to their group. Each group and its members must comply with the provisions of these GTU.

 

Posting job offers

All Users of the Site who may post a job offer undertake to comply with these GTU and, in particular, not to use prohibited or discriminatory criteria, including the following: origin, gender, morals, sexual orientation or identity, age, family status or pregnancy, genetic characteristics, real or supposed membership or non-membership of an ethnic group, nation or race, political opinions, trade union or mutualist activities, religious beliefs, physical appearance, etc. (Art. L 1132-1, L 1142-1 of the Labour Code).

 

Protection of Personal Data

TBS Alumni is responsible for processing the personal data referred to herein.

 

The data collected when creating an Account concerning Users of the Website comes from TBS Education or TBS Alumni. This data is necessary to obtain an Account and access to the Services. It includes at least the first name, last name, email address, and academic background.

 Other data is updated optionally by Users themselves from their profile in order to present their expertise and projects to other Users with the aim of interacting and creating opportunities for exchanges, networking, and generating statistics on professional mobility:

 

  • Profile photo
  • Profile descritpion
  • Personal contact details (telephone, mobile, personal email address(es), main and secondary address), date of birth, marital name, family status
  • Current employment and professional contact details (position, job title, company, sector, email address)
  • Previous employment
  • Current situation and professional aspirations
  • Skills acquired and languages spoken
  • Additional training
  • Community involvement and interests
  • Curriculum vitae (via uploaded file or generated using the above information)

 

Users' identities are only publicly visible if the User has activated their public profile or Public CV. Each User is free to activate or deactivate their public profile at any time.

 

The information collected from network Users via their profiles can only be viewed by other network Users (students, graduates, authorised recruiters, Administrators). Users can manage their privacy settings to restrict access to their profile information based on the type of User.

 

Recruiter Users provide the following information when creating an Account:

- Title, first name, last name, email address, position within the company

- Company name, category and address

 

External visitors to the network who register for an event must provide the following minimum information:

- First name, last name, email address

 

And, depending on the event, the following information:

- Address, telephone number, mobile number, date of birth, current position, company, business address, business email address

 

When paying for a Service on the Website (event or membership fees), we will ask you to provide delivery and billing address information in order to create an order and associated receipt. For more information on the data we store, see our LNPP.

 

Users agree to always provide sincere and truthful Personal Data and to update it as necessary so that it remains complete and accurate. We will regularly ask you to do so.

 

The information about a User contained in the TBS Alumni database remains the property of that User. In accordance with current European regulations, and in particular European Regulation (EU) 2016/679 (hereinafter ‘GDPR’), Users of the Site have the rights set out in our LNPP.

Security

The User of the Website acknowledges that they are aware of the risks associated with the use of the Internet and networks, and namely information relating to their personal data may be copied or intercepted.

 

The User and/or visitor to the Website acknowledges that they accept these risks, for which TBS Alumni cannot be held liable under any circumstances. TBS Alumni, for its part, deploys all technical and human resources to ensure a permanent level of security in accordance with current best practices in this field and to prevent malicious acts. To this end, we use protective measures to safeguard your information, such as firewalls and encrypted data transmission using SSL/HTTPS technology.

 

Intellectual property on the Website

The TBS Alumni Website, including its architecture, graphics and content, is protected by the provisions of the Intellectual Property Code. You agree not to engage in any activity that may directly or indirectly infringe upon the intellectual property rights of TBS Alumni or, where applicable, the property rights of third parties.

 

Thus, the use, reproduction, transmission, commercialisation or creation of derivative works based on the Website without the prior written consent of the Association is strictly prohibited and may be punished as an infringement.

 

Any person who creates a file or database containing information from the TBS Alumni Website and makes it available to a third party, whether for a fee or free of charge, without the consent of TBS Alumni and in violation of the Terms of Use, shall be liable to civil and/or criminal penalties under the Intellectual Property Code.

 

Guarantee

TBS Alumni undertakes to take particular care regarding the accuracy of the information exchanged on the Site and to keep it regularly updated. However, errors or omissions may occur. In this case, please notify us so that we can make the necessary corrections.

 

TBS Alumni does not guarantee uninterrupted access to the Site, particularly in the event of maintenance, repairs or internet connection disruptions. TBS Alumni cannot be held liable for technical failures and related data loss, nor for any other indirect damage occurring during or related to the use of the Site.

 

The GTU are governed solely by French law. Any dispute arising from the validity, interpretation and/or execution, termination or breach of these Terms of Use, and after failure of any conciliation, shall be submitted to the appropriate court.
